Having a solid Terms of Service for your website is crucial. While this is easily the dullest page on your website - it's the one page that can save you a ton of legal headache in the future.

Terms of service (also known as terms of use and terms and conditions, commonly abbreviated as ToS or TOS and TOU) are rules which one must agree to abide by in order to use a service. Terms of service can also be merely a disclaimer, especially regarding the use of websites.

A well developed Terms of Service will set out 4 key areas:

  • Limiting your liability: You’ll want to have some kind of disclaimer aimed at limiting your liability in cases where there are errors in your web content. This will be some kind of clause that says you can’t be held responsible for any errors in content or that the information provided is accurate, complete, or suitable for any purpose.
  • Copyright: Regardless of what your website does, you should always include a notice about copyright and trademark. For example, “Copyright©2014. Your website.com.”
  • Privacy Policy: If you are collecting any information from your customers (such as email addresses or credit card information), you need to post a privacy policy outlining how this information will be used or not used. This is the only part of the Terms and Conditions that is legally required.
  • Set the governing law: Your Terms and Conditions should also mention where your website is operating from in terms of the governing law (state/province and country). For example, “These terms and conditions are governed by the laws of the United States of America and the laws of the State of California.”
